St Louis threatens to prosecute "false speech" against Sen Obama

From the "Show Me" state this interesting story arises.

St Louis Circuit attorney Jennifer Joyce and St. Louis County Circuit Attorney Bob McCulloch are threatening to bring libel charges against those who speak out falsely against Senator Barack Obama.

KMOV broadcast a story last night, that stated St. Louis City Circuit Attorney Jennifer Joyce and St. Louis County Circuit Attorney Bob McCulloch, both Obama supporters, are threatening to bring criminal libel charges against anyone who levels what turns out to be false criticisms of their chosen candidate for President.

Will Sheriff James W. Murphy, a Democrat, was elected to the Missouri State Senate in 1976 and reelected in 1980,  enforce this policy?  Will this policy be enforced against those that speak out falsely against Sen McCain and Gov Palin?

Gov Palin and Sen Biden are due to debate in the Vice Presidential debates at 8 pm on the 2nd of October at Washington University in St Louis.  Will the Sheriff go on stage and place Gov Palin under arrest if the Circuit Attorneys think she is speaking falsely?

Are the Democrats now willing to use the judicial system to stifle and control free speech?  Who determines what is false given the number of unanswered questions concerning Sen Obama? Indeed, if a reporter publishes an article concerning Sen Obama and his links with Bill Ayers (former SDS member) and his wife Bernardine Dohrn, both former Weatherman members, will Sen Obama then be required to testify regarding his relationship with Ayers?  He has gone to great lengths to distort this relationship in the past.

Slippery sloop.  This has the potential to boomerang on the Democrats.  But then again, this isn't the doings of Sen Obamas campaign committee; just another incident by well meaning, enthusiastic supporters.

Stating my opinion concerning the adequacy (or lack thereof)of a presidential or vice presidential candidate is not tantamount to "rat fucking". It is my constitutional right to do so.

Hi David, thanks for this post, this story is of great interest to me since I live in Missouri, although on the other side of the state in KC. They are not even pretending anymore are they? They are willing to truly subvert the Constitution to get their candidate elected. They probably think it's OK because after all, in their fantasy world GWB stripped us of free speech with the Patriot Act. They claim to be living in a police state and that their civil rights are being trampled on ... talk about projection! They are the ones who are acting like fascists.
